TERMS AND CONDITIONS

Eligibility: This Campaign is open to schools, sporting clubs, registered charities and not-for-profit organisations in Australia. Organisation’s must have an ABN number and may register once only.

This Campaign is run in all States and Territories of Australia. No permits required.

Agreement to Rules: By participating, the Contestant (“You”) agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Bolsta Fundraising Pty Ltd as final and binding as it relates to the content of this Campaign.

Campaign And Competition Periods: This Campaign comprises of rolling monthly Competitions. Each monthly Competition commences 12:00:01 am on the first day of each month and concludes midnight on the last day of that same month. There is no defined end date for this Campaign. It will continue every month until withdrawn at the discretion of Bolsta Fundraising Pty Ltd.

How To Register An Organisation: An individual can register an organisation by creating a Member Profile at https://bolsta.co/bolsta-big-up. Once the registration has been approved the organisation will become a BIG UP Member. Organisations need to register once only, and remain a current BIG UP Member whilst their Member Profile is active. All active Member Profiles are displayed in the ‘Member Gallery’ at https://bolsta.co/bolsta-big-up.

Member Draw: A Member Draw will be conducted on the 1st working day of each month. This is a random draw giving every entrant an equal chance of winning a $500 cash prize. Every active BIG UP Member will receive one (1) automatic entry in the Member Draw provided their registration was approved prior to midnight on the last day of the month preceding the draw.

BIG UP Bonus: The BIG UP Bonus is an amount (currently $2000 per month) that is provided to BIG UP Members who choose to participate in the BIG UP Challenge set for that month. The BIG UP Bonus will be distributed based on the requirements set in the challenge for that particular month. The distribution of the bonus is specified in the following section titled ‘BIG UP Challenge’. It may be distributed as one amount or multiple smaller amounts.

The BIG UP Challenge must be successfully completed between the period 12:00:01 am on the first day of the month and midnight on the last day of the month to qualify for the BIG UP Bonus.

If the BIG UP Bonus is distributed by way of a draw, the draw will be conducted on the 1st working day of each month for entries obtained in the preceding month. Every entry will have an equal chance of being drawn.

If the bonus is to be distributed at the discretion or judgement of Bolsta Fundraising Pty Ltd, the decision will be made by its 3 directors. The BIG UP Challenge is completed by individuals on behalf of an organisation and may vary from month to month.

BIG UP Challenge (April 2023):

April’s BIG UP Challenge is a Facebook competition. All following references to ‘Competition Post’ are referring to this Facebook Post.

Entrants are invited to select one (1) of the three (3) eggs displayed in the Competition Post image. One egg contains 1 entry, one egg contains 2 entries & one egg contains 3 entries into April’s BIG UP Draw. The number of entries each egg contains will be revealed at the end of the competition period.

Entrants will receive an equivalent number of entries in the BIG UP draw, that are contained in the egg they have selected (1, 2 or 3). One BIG UP entry will then be selected at random and the winner’s nominated organisation will receive $2000.

An entry is valid when all the following conditions are met:

An egg number (between 1 and 3) is written in the comments of the competition post
A BIG UP Member organisation is nominated in the comments of the competition post (The organisation has until midnight 30th April to register)
The entrant has not submitted a previous entry (Only the first valid entry per person will be accepted)

Membership Cancellation: A BIG UP Membership may be cancelled at any time by notifying Bolsta Fundraising Pty Ltd in writing. Please send requests to [email protected]. The profiles of cancelled BIG UP Members will be removed from the Member Gallery.

The entry must fulfil all Campaign requirements, as specified, to be eligible. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Bolsta Fundraising Pty Ltd. You must provide the information requested. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If You use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of Bolsta Fundraising Pty Ltd.

The prize is non-transferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for Bolsta Fundraising Pty Ltd to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

Winner Selection and Notification: Winner will be selected under the supervision of Bolsta Fundraising Pty Ltd. Winner will be notified by phone or email within one week following selection of Winner. Bolsta Fundraising Pty Ltd shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information.

If Winner cannot be contacted, is ineligible, fails to claim the prize within 30 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected. Receipt by Winner of the prize offered in this Campaign is conditioned upon compliance with any and all federal, state, and local laws and regulations.

ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (at Bolsta Fundraising Pty Ltd sole discretion) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CAMPAIGN, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Rights Granted by You: By entering this content (e.g., photo, video, text, etc.), You understand and agree that Bolsta Fundraising Pty Ltd, anyone acting on behalf of Bolsta Fundraising Pty Ltd, and Bolsta Fundraising Pty Ltd licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes. without any further compensation, notice, review, or consent.

Optional verbiage for Contest: By entering this content, you represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, You will be disqualified at the sole discretion of Bolsta Fundraising Pty Ltd. If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, you shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Bolsta Fundraising Pty Ltd from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Bolsta Fundraising Pty Ltd may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

Terms & Conditions: Bolsta Fundraising Pty Ltd reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Campaign should virus, bug, non-authorised human intervention, fraud, or other cause beyond Bolsta Fundraising Pty Ltd control corrupt or affect the administration, security, fairness, or proper conduct of the Campaign. In such case, Bolsta Fundraising Pty Ltd may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Bolsta Fundraising Pty Ltd. Bolsta Fundraising Pty Ltd reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Campaign or website or violates these Terms & Conditions. Disputes: THIS Campaign IS GOVERNED BY THE FEDERAL LAWS OF AUSTRALIA WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Campaign, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Campaign, shall be resolved individually, without resort to any form of class action, exclusively before a court located in [location] having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Campaign). 51 Trees

“My name is Moya Stewart and myself and other local residents became passionate about saving a stand of old growth gum trees in our township.

These trees are on a large parcel of land purchased for a housing development close to our town and enjoyed by local residents and wildlife.

In the development’s initial plans the trees were to remain and most of the houses built on treeless paddocks elsewhere on the land.

When residents found out that the developer had been granted an amendment by council allowing him to build approx. 400 residences on this treed part of the land and remove 51 mature gum trees to do so they were stunned. People submitted many objections to council and the developer. When these objections were heard and rejected the residents banded together and decided to appeal to VCAT. A specialist environmental lawyer was employed and an urban planner to draw up alternative plans that would incorporate most of the new dwellings and save most of the trees. We prepared and waited for the VCAT hearing. Unbeknown to us the Minister for Planning withdrew the case to have his team asses fast tracking the development to assist a ‘building led covid recovery’. Thus more preparation and the lawyers and resident’s representatives having to attend hearings with the Minister for Planning and his team. A costly exercise! We were thrilled when the Minister unexpectedly declined the developer’s proposal.

So that’s were we stand at the moment. We won and the trees remain! But It’s been a long and expensive fight for us and we have been left with significant debts which we are still fundraising to pay and will be for a long time yet.

So we thank you for the win from Bolsta. It does help and it also boosts our morale and motivation to keep going”.

“Crowajingalong Scout Group is based in Evatt in the ACT. As the local part of the world-wide Scouting movement, we provide a diverse range of activities and experiences to youth members from 5 to 18 years old. Our youth participate in programs that encourage them to grow through adventure by experiencing new challenges, making new friends, building confidence, taking responsibility for themselves, and being provided with opportunities to explore their own abilities and interests. 2020 was a challenging year for our Scout group. Like so many others we had to find ways of making our activities online-only for a while, we couldn’t run our normal fundraising activities and many of our families were impacted by the shutdowns, leaving us with much less income than usual to fund things like our hall maintenance, our leader training and the usual bills. On top of that, we recently had to replace our electrical switchboard and will have to replace a fence in the upcoming months. We entered this competition because social cohesion and a positive learning environment is what is needed at this school. Students affected by the pandemic also need a happy place to learn in and the money will be used for new play equipment.

A Better Life For foster Kids

Based in Gippsland, Victoria, A Better Life for Foster Kids (ABLFFK) was founded in 2014 by Heather Baird, who herself grew up in foster care. ABLFFK works to improve short and long-term physical, educational and psycho-social outcomes for children in foster care and kinship care. Our aim is to preserve children’s dignity, improve their feelings of self-worth and lessen social stigma. We provide material assistance to children in care, as well as advocacy and support for carers to help them navigate the out of home care system.
ABLFFK is unique in providing Crisis Cases, which contain all the clothing and essential items required for the first week of care, where and when they are needed by carers, without administrative red tape. Around 85% of children arrive in their placement with only the clothes they are wearing, having been removed in emergency circumstances. As well as providing essential items needed in a child’s first week in care, Crisis Cases contain handmade blankets and toys sent from people all over Australia that show children their community cares for them. Books provided for 5-12 year olds allow them to tell their story, helping them to process trauma and move forward. Crisis Cases also create significant mental and financial relief for carers.
Each Crisis Case contains around $295 worth of items, with over 75% of these donated by community members and businesses.

Each Crisis Case costs approximately $50, so funding from Bolsta will allow us to provide dignity and comfort to 20 children entering out of home care!
